We feel it is important that both parties know exactly what to expect prior to working together in order to ensure a mutually beneficial working relationship with each other. Below are the terms of service for Pro Property Photos and Wasim Muklashy Photography.

Photography, Virtual Tour Services, and Google MyBusiness Listing Optimization Services
Refund/Cancellation
We will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print or in electronic format. No exception can be made as I cannot be held responsible for individual tastes or exceptions.
Should digital files be lost, damaged or destroyed the photographer(s) liability shall be limited to a refund of fees paid, but shall not include a refund for any goods already supplied or capable of supply at a quality deemed acceptable by the photographer.
No refund will be due for any digital files lost, damaged, or destroyed after 12 months from the date of the shoot.
What is a “goodwill” refund policy?
“Goodwill” means I’m happy to offer partial reimbursement on a client by client basis. As per contract I’m not legally obliged to offer a refund for things like images lost due to technical failure, amount of photographs received by the client, etc.
A “goodwill” gesture is at the discretion of the photographer.
If a “gesture of goodwill” is given, no further refund will be given for any subsequent complaints that occur, and no further claim will be considered.
Any complaints should first be raised by the Client with “Wasim Muklashy Photography” in writing no later than 21 days from the date of receipt of images.

Digital delivery via Google Drive, Dropbox, Firefox Send or similar unless otherwise arranged.
Expected Timeframes
24-96 hours as detailed at www.ProPropertyPhotos.com, depending on services requested

Force Majeure
Wasim Muklashy Photography shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.
Limitation of Liability
The Client acknowledges and agrees that Wasim Muklashy Photography will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.
No Guarantee
The client acknowledges and agrees that Wasim Muklashy Photography cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results are promised.
